DEFINITIONS
Unless otherwise specified, the capitalized terms shall have the meanings set out below:
Account means and includes the account created on the Site, by the User, in accordance with the terms of the Agreement, registered with and approved by Habinx.
Agreement means and includes the Terms and Conditions, Privacy Policy and any other such terms and conditions that may be mutually agreed upon between Habinx and the User in relation to the Services.
Applicable Law means and includes any statute, law, regulation, sub-ordinate legislation, ordinance, rule, judgment, order, directive, circular or governmental restriction applicable to this Agreement.
Broker includes brokers, agents, intermediaries, channel partners or any person facilitating property transactions for commission or fees.
Confidential Information means all non-public business, technical, financial or user-related information belonging to Habinx or its partners.
Content means all information, data and material available on the Site.
Government Authority means any governmental, regulatory or judicial authority.
Information Technology Act means the Information Technology Act, 2000.
Intellectual Property includes trademarks, copyrights, patents, designs, software, processes and proprietary materials.
Intellectual Property Rights means rights relating to Intellectual Property under applicable law.
Habinx means Habinx Private Limited, a company incorporated under the Companies Act, 2013, operating the website https://habinx.com and its mobile application.
Privacy Policy means the privacy policy of Habinx.
Prohibited Conduct includes misuse of Services, unlawful activity, infringement of rights, spam, fraud or unauthorized access.
Registration Data includes mobile number, email address and other details provided during registration.
Personal Information includes Aadhaar, PAN, financial details and other sensitive personal data.
Services means property listing, renting, buying, documentation, advertising and related services offered by Habinx.
Site means https://habinx.com and the mobile application operated by Habinx.
Third Party Service Provider means external service providers engaged by Habinx.
User means any individual accessing or using the Site or Services.
User Information includes all data provided by the User.
2. INTERPRETATION
- Laws include amendments and re-enactments.
- References to persons include individuals, companies or entities.
- Headings are for convenience only.
- Singular includes plural and vice versa.
3. ACCEPTANCE OF TERMS
i. By using the Site, the User agrees to this Agreement and Privacy Policy.
ii. Continued use constitutes acceptance.
iii. Users must be 18+ or use under guardian supervision.
4. ACCESS TO SITE
- Users may browse without registration.
- Account creation is required for full Services.
- OTP verification may be required.
- Multiple accounts are prohibited.
5. SUBSCRIPTION PLANS
- Paid plans may be offered.
- Fees are generally non-refundable (unless stated).
- Habinx may revise pricing anytime.
6. USER INFORMATION
- Users are responsible for accuracy of their data.
- Habinx is not liable for loss or misuse of User Information.
- Habinx may remove or restrict content.
7. RIGHTS OF HABINX
Habinx may:
- Suspend or terminate accounts for violations;
- Verify user identity and detect brokers;
- Modify or discontinue Services;
- Send notifications and promotional messages (opt-out available at info@habinx.com).
8. DATA PROTECTION RIGHTS
Users may have rights such as:
- Access to data
- Correction
- Deletion
- Restriction of processing
Requests can be made at info@habinx.com.
9. UNAUTHORIZED ACCESS
- Users are responsible for account security.
- Report misuse immediately.
- Habinx is not liable for unauthorized access losses.
10. USE OF INFORMATION
Habinx may use User Information for:
- Providing Services
- Internal analysis
- Marketing and communication
- Connecting with third-party providers
- Legal compliance
Third Party Services
- Services may involve third parties.
- Habinx is not liable for third-party interactions.
Advertising
- Cookies may be used for personalized ads.
- Third parties may display ads.
11. PLATFORM ROLE
- Habinx is a facilitator only.
- Users interact at their own risk.
- No guarantee of transactions or user authenticity.
12. PAYMENTS (HABINX PAY)
- Habinx facilitates payments via third-party gateways.
- Not a bank or financial institution.
- Users must provide accurate payment details.
- Transactions may be delayed or rejected.
- Refunds processed as per policy.
- Habinx is not liable for payment disputes.
13. PACKERS & MOVERS
- Services are at User’s risk.
- Users must verify goods and claims promptly.
- Additional charges may apply.
- Habinx is not liable for damages beyond negligence.
14. CREDIT INFORMATION
- Users authorize Habinx to obtain credit reports (if applicable).
- Data used only for specified purposes.
- Data is deleted after use (max 6 months).

15. CONTENT RULES
Users shall not:
- Post illegal or harmful content
- Violate IP rights
- Spread malware or spam
- Reverse engineer the platform
16. USER GENERATED CONTENT
- Users retain ownership of content.
- Habinx may monitor/remove content.
- No guarantee of accuracy.
17. INTELLECTUAL PROPERTY
- Users must not misuse Habinx content.
- Habinx retains rights over platform data.
- Legal action may be taken for infringement.
18. TECHNICAL RISKS
- Site may face bugs or downtime.
- Habinx is not liable for technical failures.
19. RENTAL AGREEMENT SERVICES
- Users must provide accurate data.
- Habinx not liable for disputes between parties.
- Users bear legal and registration costs.
20. FINANCE PARTNERS
- User data may be shared with finance partners.
- Users consent to communication via calls, SMS, email.
- DND restrictions may not apply.
21. LIMITATION OF LIABILITY
Habinx’s liability is limited to the amount paid by the User for Services.
22. INDEMNITY
Users agree to indemnify Habinx against:
- Breach of terms
- Legal violations
- Fraud or misconduct
23. RERA COMPLIANCE
- Users must verify property compliance.
- Habinx does not guarantee listings.
24. LAW ENFORCEMENT

25. WAIVER & SEVERABILITY
- Failure to enforce rights is not a waiver.
- Invalid clauses do not affect others.
26. AMENDMENTS
- Terms may be updated anytime.
- Continued use implies acceptance.
27. GOVERNING LAW
- Governed by Indian law.
- Jurisdiction: Agra courts.
